Possible Penalties for Sex Crimes in Indiana 

Depending on the offense, prison sentences can range from a few years to several decades. Serious charges, such as rape or child molestation, often come with mandatory minimum sentences, leaving little room for leniency.   • Child molestation – per IC 35-42-4-3, this can be charged as a Level 3 felony, with 3-16 years in prison, or a Level 2 or 1 felony, depending on the circumstances of the case.  
  • Sexual misconduct with a minor – charged as a Level 5 felony (1-6 years) without aggravating circumstances, but could be charged at higher levels depending on age of the offender, the use of force, and/or if drugs were involved in the commission of the offense. 
  • Child exploitation – a Level 5 felony (up to 6 years) or Level 4 felony (up to 12 years).
